JAMES W. COLBERT III
Mr. Colbert has over 40 years of experience in complex litigation. Following a clerkship with the Hon. Shirley M. Hufstedler of the United States Court of Appeals for the Ninth Circuit, Mr. Colbert joined O’Melveny & Myers LLP in 1971, becoming a partner in 1978 and practicing litigation at that firm for 34 years. In 2005, Mr. Colbert became a prosecutor in the Office of the Los Angeles City Attorney where he worked for the next 6 years, helping to establish the unit in that office responsible for prosecuting complex actions under the Unfair Competition Law (California Business & Professions Code §17200 et seq.) and other statutes authorizing similar civil law enforcement actions. Mr. Colbert joined King Cheng & Miller in the fall of 2011.
Mr. Colbert has practiced extensively at the trial and appellate level, handling a wide variety of cases.
· At the trial level, he has tried numerous cases to juries or to the bench in the Superior Courts for Los Angeles, Orange, Riverside, San Bernadino, Ventura, Santa Barbara, Santa Clara and San Mateo Counties, and in the federal district courts for the Central and Northern Districts of California, the District of Arizona and the District of the United States Virgin Islands. He has also been lead counsel on an even greater number of cases in state and federal courts throughout California and in federal courts in many other states that were resolved short of trial.
· At the appellate level, he has briefed and argued dozens of matters before state and federal appellate panels. Cases in which Mr. Colbert was lead counsel in both briefing and arguing the matter include cases heard by the United States Supreme Court, the California Supreme Court, the federal Courts of Appeals for the Ninth Circuit and the Federal Circuit, and Courts of Appeal for the First, Second, Fourth and Sixth Appellate Districts.
· Mr. Colbert has handled substantial matters in the following areas: professional responsibility of lawyers and accountants; federal antitrust law; federal and state securities law; consumer protection, including California’s unfair competition law; intellectual property; employment law; land use regulation, including state and federal environmental review of projects; eminent domain; class actions; public utilities; public finance; and California contract and tort law.
